These Terms are a binding contract between you and the operator named below for your use of the SleepyCuddle mobile app and the website sleepycuddle.com (together, the "Service"). The Service is offered to consumers in the EU/EEA only. The English version of these Terms governs; translations are provided for convenience only.

1. Who we are

"We", "us" and "our" mean the operator named above. "You" means the adult account holder.

2. These Terms

By creating an account or using the Service you accept these Terms. Read them together with our Privacy Policy and — before recording your voice — the Voice & Biometric Consent.

Nothing in these Terms removes or limits any right you have under mandatory Spanish or EU consumer law, including the consolidated Spanish consumer statute (Real Decreto Legislativo 1/2007, "TRLGDCU"). Where a term conflicts with such a right, the mandatory right prevails.

3. Eligibility and parental responsibility

You must be at least 18 years old and able to enter into a contract. Children do not hold accounts and never sign in.

When you add a child profile, you confirm that you are the child's parent or legal guardian (or otherwise hold parental authority) and are entitled to provide the profile details: a first name — used only to label the profile, not inserted into story text — an approximate age, story preferences and a chosen illustrated avatar. You are responsible for supervising your child's listening.

Your account is personal to you and your household. Do not share it, sell it, or let anyone outside your household use it.

4. The Service

  1. You record your own voice. With your separate explicit consent, it is turned into a personal voice clone.
  2. You generate a bedtime story, choosing its duration and themes for a child profile. Stories are personalised through themes, preferences and age.
  3. The story is narrated in your cloned voice and played back for your child.

Stories are machine-generated by AI. They are family entertainment, not professional, educational, medical or any other kind of advice, and they may contain imperfections or unexpected turns. You can read each story in the app before playing it — you decide what your child hears.

The Service is for private, family, non-commercial use and contains no advertising. We keep improving the Service and may change features, provided we do not deprive you of what you have paid for.

5. Purchases through the app stores

SleepyCuddle is distributed exclusively through the Apple App Store and Google Play, and every payment — subscriptions and story-time top-ups — is made through the store's billing system. Nothing is sold on the website.

  • The store is the seller. When you buy through the App Store, your purchase contract is with Apple Distribution International Ltd (Ireland); when you buy through Google Play in most EEA countries, it is with Google Ireland Ltd. The store's own purchase terms apply alongside these Terms.
  • Prices. The price is the one shown in the app at the point of purchase. It includes VAT, which the store calculates, collects and remits for your country.
  • Payment data. The store processes your payment; we never receive your card or bank details.

6. Story time, subscriptions and top-ups

Story time is measured in minutes and lives in two separate balances:

  • Consumption order: subscription minutes are always spent first; then top-up minutes, soonest-expiring first.
  • What a story costs: when you generate a story you choose its duration (for example 10, 20 or 30 minutes). Your balance is charged the duration you chose, fixed at the moment narration is queued — not the exact length of the finished audio.
  • Top-ups need a subscription: top-up minutes can be purchased only while you have an active subscription or trial.
  • Auto-renewal: subscriptions renew automatically through the store at the end of each period until you cancel in the store's subscription settings (Section 8).
  • Trial: where a free trial is offered, the store shows you its length and when paid billing starts before you confirm.

7. No subscription, nothing plays

If you have neither an active trial nor an active subscription, your account is locked:

  • You can still sign in and see your account — we never lock you out of it.
  • Nothing is playable: no story playback, no story generation, no narration, no voice recording — even if minutes remain on a balance. Remaining top-up minutes lie dormant, are not consumed, and become usable again when you subscribe — provided they have not yet expired under Section 6.
  • The only available actions are: subscribe or renew through the store, buy a plan, or delete your account.

8. Cancellation, refunds and your right of withdrawal

Cancelling a subscription. Store subscriptions are cancelled in the platform's subscription settings — on Apple devices under Settings → Apple Account → Subscriptions; on Android in the Play Store → Payments & subscriptions → Subscriptions. The app links you there. We cannot cancel a store subscription for you, and deleting your SleepyCuddle account does not by itself cancel it. After you cancel, your plan simply does not renew; your access and remaining subscription minutes last until the end of the period already paid.

Your 14-day right of withdrawal. As an EU/EEA consumer you have a 14-day right of withdrawal for distance purchases (Directive 2011/83/EU, as implemented in the TRLGDCU). Because the store is the seller, you exercise it against the store, through its refund process:

For digital content and services supplied immediately, the law allows the right of withdrawal to lapse once delivery begins, where you expressly requested immediate performance and acknowledged losing the right — the stores ask you for exactly this during checkout. The store decides refund requests under those rules and its own policies.

Your statutory guarantee stays with us. Independently of store refund decisions, you always have the statutory conformity rights of the TRLGDCU (implementing Directive (EU) 2019/770 on digital content and services): if SleepyCuddle does not work as described — stories will not generate, audio will not play — you can require us, free of charge, to bring the service into conformity and, where that fails, to give a proportionate price reduction or refund. Write to support@sleepycuddle.com. Nothing in these Terms limits those rights.

9. Your voice and the voice-clone licence

  • Only your own voice. You may record only your own voice — never a child's and never another person's. A voice identifies its owner; cloning a voice you have no right to is a material breach of these Terms.
  • Biometric consent. Your recording and the clone derived from it are biometric data, processed only under the separate Voice & Biometric Consent, which you can withdraw at any time.
  • The licence you grant us. You grant us a limited, non-exclusive, revocable, royalty-free licence to process your recording and to create and use your voice clone solely to narrate your own family's stories within the Service. We never make your voice available to other users and never use it for any other purpose. The licence ends when you delete your account or withdraw consent, at which point the recording and the clone are deleted.
  • No impersonation. You must not use the Service, or audio produced with it, to deceive anyone about who is speaking or to harm the person whose voice is heard.

10. Stories and acceptable use

Your inputs — child profile details and story preferences — remain yours; you grant us the licence needed to generate and narrate stories from them. Generated stories, text and audio, are for your household's private, non-commercial use. You may not sell, publish, broadcast or otherwise commercially exploit them.

You must not:

  • use the Service unlawfully or to harm anyone;
  • attempt to generate content that is abusive, hateful, sexual, or otherwise unsuitable for a children's service;
  • bypass or defeat technical or safety measures;
  • reverse-engineer, scrape, overload or gain unauthorised access to the Service;
  • resell the Service or use it to build a competing product.

We may suspend or terminate accounts that breach this section (Section 13) and report unlawful activity to the competent authorities.

11. Intellectual property

The Service — the SleepyCuddle name, the apps, the website, the underlying software, designs and illustrations — belongs to us or our licensors. You receive a personal, non-transferable, non-exclusive, revocable licence to use it for its intended family purpose, and no other rights.

12. Disclaimers and liability

We provide the Service with reasonable care and skill, but — without affecting your statutory rights — we do not promise that it will be uninterrupted or error-free, or that AI-generated stories will meet a particular expectation.

We do not exclude or limit liability for death or personal injury caused by our negligence, for fraud, for wilful misconduct or gross negligence, or for anything that cannot be excluded under mandatory Spanish or EU consumer law — including your conformity rights in Section 8. Subject to that, we are not liable for loss that was not reasonably foreseeable or for commercial losses (the Service is for family use), and our liability is otherwise limited to the foreseeable loss caused by our breach.

13. Termination

You may stop using the Service and delete your account in the app at any time; this permanently erases your data as described in the Privacy Policy. Remember to also cancel your subscription in the store's subscription settings — deleting the account does not cancel it (Section 8).

We may suspend or terminate your access if you materially or repeatedly breach these Terms, if the law requires it, or where necessary to protect users or children — with prior notice and a chance to put things right where that is reasonable. Provisions that by their nature survive (licence endings, intellectual property, liability, governing law) continue to apply.

14. Governing law and disputes

These Terms are governed by Spanish law; as a consumer you also keep the mandatory protections of the law of your EU/EEA country of residence. Please contact support@sleepycuddle.com first — most problems can be fixed quickly.

If we cannot resolve a dispute, you may turn to the Spanish consumer arbitration system (Juntas Arbitrales de Consumo) or your local or regional consumer office (OMIC); on request we will tell you which alternative-dispute-resolution entity is competent for your complaint. You may also bring proceedings before the competent courts, including, as a consumer, the courts of your own domicile. For personal-data concerns you can always complain to the AEPD (www.aepd.es).

15. Changes to these Terms

We may update these Terms when the Service or the law changes. For material changes we give advance notice by e-mail or in the app; if you do not agree, cancel your subscription in the store and stop using the Service before the change takes effect. The effective date above shows the current version.
