This Legal Notice ("Aviso Legal") sets out the general information and conditions of use of the website sleepycuddle.com (the "Website") and the SleepyCuddle service provided through it (the "Service"). It is published in compliance with the duty of information imposed on providers of information-society services by Article 10 of Spanish Law 34/2002, of 11 July, on Information Society Services and Electronic Commerce (LSSI-CE).

Use of the Website attributes to you the status of user and implies your full acceptance of the conditions set out in this Legal Notice. Please read it carefully.

3. Nature and Purpose of the Website and Service

SleepyCuddle is an AI-powered family bedtime-storytelling service, available as a mobile application and through the Website, offered exclusively within the European Union / European Economic Area.

The Service allows an adult parent to record their own voice, which is turned into a personal voice clone by third-party AI providers. The Service then generates personalised bedtime stories using AI and can play them back narrated in the parent's cloned voice, for that parent's own children. Every story is first shown to you as text; it is voiced in your cloned voice only after you approve it and it passes automated safety checks.

Children do not hold accounts and never sign in. Only adults hold accounts. A parent may provide limited information about their child (first name, approximate age, preferences, and a chosen illustrated avatar) solely to personalise the stories. The Service displays no advertising and carries out no behavioural advertising.

The Service is sold exclusively via the Website using our third-party payment processor. It is not distributed or billed through any application store. Current commercial terms (free "First Story", monthly subscriptions and top-ups, all inclusive of Spanish VAT/IVA) are described in the applicable Terms of Service and at the point of purchase.

4. Conditions of Use of the Website

By using the Website you agree to:

  • use the Website and Service in accordance with the law, this Legal Notice, the Terms of Service, and good faith and public order;
  • provide truthful and up-to-date information when creating an account or making a purchase, and to keep your access credentials confidential;
  • only record and submit your own voice, or a voice you are lawfully entitled to record, and to hold an account only as an adult;
  • refrain from any use that is unlawful or harmful, that infringes the rights of third parties, that disrupts the normal operation of the Website, or that attempts to gain unauthorised access to its systems or data.

The provider may suspend or withdraw access to the Website or Service, wholly or in part, where reasonably necessary to comply with the law, protect users, or preserve the security and integrity of the Service.

5. Intellectual and Industrial Property

The Website and its content — including but not limited to its source code, design, structure, texts, graphics, logos, illustrated avatars, the "SleepyCuddle" trade name, and other distinctive signs — are owned or used by [OPERATOR FULL NAME] under the corresponding licences, and are protected to the extent provided by applicable Spanish and EU intellectual- and industrial-property law.

Stories generated for you through the Service, and audio produced in your own recorded voice, are made available for your personal, private, non-commercial family use in accordance with the Terms of Service. Third-party names and marks referred to on the Website belong to their respective owners.

The provider makes reasonable efforts to keep the Website available and its information accurate and up to date, but does not guarantee the uninterrupted or error-free availability of the Website, nor the absence of technical incidents beyond its reasonable control. To the extent permitted by applicable law — and without limiting any mandatory rights that consumers enjoy under the Spanish consolidated Consumer Protection Act (Royal Legislative Decree 1/2007, TRLGDCU) — the provider is not liable for damage arising from misuse of the Website or from causes outside its reasonable control.

Nothing in this Legal Notice excludes or limits any liability that cannot be excluded or limited under applicable law.

The Website may contain links to third-party websites or services. Such links are provided for convenience only. The provider does not control and is not responsible for the content, policies, or practices of those third-party sites, and their inclusion does not imply any endorsement.

7. Privacy and Cookies

The processing of personal data through the Website and Service — including the parent's voice recording and derived voiceprint/voice clone, which constitute biometric data under Article 9 of the EU General Data Protection Regulation (GDPR) — is governed by our Privacy Policy. This biometric data is processed only on your separate explicit consent (Article 9(2)(a) GDPR), which is distinct from your acceptance of the general Terms and which you may withdraw at any time — by deleting your account from the app, which permanently erases the recording and voice clone, or by contacting us at [CONTACT EMAIL]. The use of cookies and similar technologies is governed by our Cookie Policy, published in accordance with Article 22.2 of the LSSI-CE.

Both documents are available on the Website and form part of the information framework applicable to your use of the Service.

You have the right to lodge a complaint with the Spanish Data Protection Agency (Agencia Española de Protección de Datos, AEPD), C/ Jorge Juan 6, 28001 Madrid — www.aepd.es, or with the supervisory authority of your EU/EEA country of residence.

8. Applicable Law and Jurisdiction

This Legal Notice and the use of the Website are governed by Spanish law.

Where you do not act as a consumer, the courts and tribunals of the city of Valencia (Spain) shall have exclusive jurisdiction over any dispute arising from or relating to this Legal Notice or the use of the Website.

Where you act as a consumer, mandatory consumer-protection rules apply: nothing in this Legal Notice deprives you of the protection of the consumer-protection provisions in force at your place of residence within the EU/EEA, and you may bring proceedings before, and be sued only in, the competent courts of your own domicile.
